INTRODUCTION

1.1 These are the terms and conditions and rules for the website lotto3.com (“Terms”).

1.2 The definitions and rules of interpretation set out in clause 23 apply to this agreement

1.3 These Terms are effective from 1 September 2024 and replace any previous terms and conditions that have governed lotto3.com. These Terms may be amended from time to time at our discretion and, if we make any changes they will apply from the date we inform you. The applicable and contemporary Terms will be posted on our website, along with any additional rules or conditions that apply from time to time. If we change the Terms, we will notify all online registered Players that have provided us with a valid email address by email.

1.4 All Tickets purchased and entry into lotto3.com are governed by these Terms which establish the rules for each of the Draws and any related promotions, collectively known as "lotto3.com”.

1.5 lotto3.com (“Lotto3”) is a large society lottery under the Gambling Act 2005. The Giving Collective CIC (“the CIC”) is a registered Community Interest Company incorporated in England and Wales with company number 13627189.

1.6 The CIC has appointed Blue Squid Studios Limited (a company incorporated in England and Wales with company number 14918289) (“us”) to promote, manage and operate Lotto3. Our address for correspondence is Blue Squid Studios Limited, Third Floor, Marlborough House, Chelmsford, Essex, United Kingdom, CM1 1LN. We are regulated and licensed by the UK’s Gambling Commission as an external lottery manager with licence number 63392.

1.7 The lottery draws operate on an hourly basis under the name “lotto3.com”. Draws run on the hour, every hour, 24 hours a day, 7 days a week and 365 days a year.

1.8 At least 20% of the proceeds of the lottery will be distributed to good causes by the CIC at the discretion of its Directors and according to its mandate to help raise money for charitable purposes in the following areas; Healthcare, Children and Young Persons, Animal Welfare, Overseas aid and Disaster Recovery. For more information see The Giving Collective. The Charity being promoted will be displayed on the lotto3 prior to the ticket being bought.

1.9 In addition to these Terms, the Lottery is subject to the terms and conditions from time to time for our Lottery Draw, Guaranteed Winner Draw and the Direct Debit scheme, all of which are available on our website.

2 WHO CAN PLAY?

2.1 In order to purchase a Ticket, enter the Lottery and be eligible to win a Prize, you must:

(a) be 18 years of age or over, and must be resident in Great Britain on the date of the Lottery Draw or Guaranteed Winner Draw;

(b) not be an Excluded Person;

(c) comply with these Terms and any other rules of the Lottery notified by us; and

(d) have an Account with us.

2.2 Syndicates are permitted to enter the Lottery and only one Player within the syndicate is required to have an Account on behalf of the whole syndicate (“Syndicate Manager”). It is the responsibility of the members of a syndicate to agree the rules for the operation of the syndicate that you participate in. We will not verify the members of a syndicate and the Syndicate Manager must ensure that no syndicate member is an Excluded Person. We will not have, and hereby exclude, all liability for and arising from the management of such syndicates. It is the responsibility of the Syndicate Manager to ensure that the syndicate and its members adheres to these Terms and to the terms of any syndicate agreement.

3 EXCLUDED PERSONS

3.1 Excluded Persons are ineligible to participate in any of our Lotteries and Excluded Persons are not permitted to receive any Prizes.

3.2 The following categories of person are classified as Excluded Persons, and therefore, are ineligible to participate in the Lottery:

(a) directors or employees of:

(i) The CIC;

(ii) Blue Squid Studio Limited; or

(iv) any company within the Blue Squid Studio Limited group of companies; or

(v) a key IT contractor or supplier of Blue Squid Studio Limited, The Giving Collective.

(b) the spouse, partner or dependent of any person described in clause 3.2(a);

(c) anyone resident outside Great Britain on the date of the Draw; and

(d) anyone that notifies us that they have chosen to self-exclude from lottery play, or who has registered with GAMSTOP to self-exclude from gambling.

3.3 By purchasing a Ticket or accepting a Prize from us, you warrant that you are not an Excluded Person.

3.4 At all times you have the option to self-exclude. Further information on self-exclusion can be found at clause 4. If you choose to self-exclude you will be prohibited from entering into a Lottery for the period of time in which you choose to self-exclude and you will be unable to accept a Prize during the time which you are self-excluded. If you self-exclude, you are prohibited from deleting your Account as we have a legal obligation to keep a record of your self-exclusion for 7 years.

4 SELF-EXCLUSION

4.1 Players should gamble responsibly. You can get information on how to gamble responsibly and how to access information about, and seek help in respect of gambling on our website, or by sending a stamped addressed envelope to our address in clause 1.5 above. Further information on gambling responsibly is available online from www.gamcare.org.uk.

4.2 You may choose at any time to self-exclude from buying Tickets for and entering into the Lottery by visiting our website and selecting the self-exclusion option in your Account.

4.3 At the start of the period of self-exclusion, all monies we hold in your Wallet will be returned to your Registered Payment Method and we will immediately suspend your ability to participate in the Lottery. If we are due to collect a Direct Debit payment within 5 working days of the date self-exclusion starts, and it is too late to prevent the deposit, we will refund any amount collected to your Registered Payment Method and will not enter you for a subsequent Draw.

4.4 You may choose the length of the exclusion period, subject to a minimum exclusion period of six months and a maximum exclusion period of five years. During this time, we will take reasonable steps to prevent you from accessing your Account, buying any Tickets or opening up a new Account.

4.5 We will not contact you at the expiry of the exclusion period. You may reinstate your Account by contacting us. We will always impose a cooling-off period of one week before your Account can become active again.

4.6 After you self-exclude from the Lottery under this clause, we will automatically remove your details from our marketing database. We will only reinstate you to our marketing database if you ask us to do so, following an exclusion period.

4.7 If you do not want to self-exclude under clause 4.1, but would otherwise like to take time out from participating in the Lottery, you can select a time out option in your Account for a period of between 24 hours and up to 6 weeks. You do this by visiting our website and setting your time-out preference in your Account. Once this time-out period has been set on your Account, we will suspend your ability to buy Tickets during the time-out period. Tickets you have already bought, and Tickets due to be bought following collection of a Direct Debit during the time-out period will remain valid, and will still be entered for Draws during the time-out period. We will remove you from our marketing database during a time-out period, and re-instate you after it, if that was your previous preference. You will not need to do anything to re-activate your ability to purchase Tickets at the end of the time-out period.

5 CONDITIONS OF ENTRY

5.1 All entry instructions displayed on our website form part of, and are incorporated by reference into, the Terms of the associated Lottery.

5.2 When you purchase a Ticket promoted by lotto3 , you accept that:

(a) you will be bound by:

(i) these Terms plus all additional rules and conditions displayed on our website that apply to the Lottery; and

(ii) any applicable provisions of The Gambling Act 2005 and any relevant regulations made under it from time to time,

(b) you will be entered into a Lottery on the date and time of the Lottery for which the Ticket is valid;

(c) any misrepresentation of fact as to your eligibility, whether intentional or unintentional, will make you an Excluded Person and ineligible to win a Prize; and

(d) we will not be liable for any loss you incur (including the loss of opportunity to enter into a Lottery and/or the right to receive a Prize) if you have not complied with the Terms.

5.3 You will only be permitted to buy a Ticket once we have verified your identity in accordance with clause 6.1 of these Terms. We retain the sole discretion to accept or reject entry into the Lottery and/or to pay out a Prize. We reserve the right to refuse entry to any Lottery or withhold any Prize if we have reasonable grounds to believe that you are in breach of these Terms. When deciding whether to refuse entry into a Lottery or paying out a Prize our decision will be final and binding and we will rely on our own technical logs and records when making our decision.

6 YOUR ACCOUNT

6.1 You need to have an Account to participate in a Lottery operated by us. To set up an Account, you must complete and submit our online registration or via our customer service centre. In order to create your account, you must tell us your:

(a) name,

(b) date of birth,

(c) residential address,

(d) contact details (including your email address); and

(e) Registered Payment Method.

6.2 We will conduct identity checks to confirm that you are at least 18 years old. Your personal information may be disclosed to a third-party agency for this purpose and they may keep a record of the search.

6.3 It is your responsibility to ensure that the information you give us when you register to play the Lottery is kept up to date.

6.4 We’ll try and conduct our verification processes electronically where possible, but if we are unable to do so, or if the check is inconclusive, we may ask you to provide us with personal identity documents. The identity documents that we may request that you provide to us are the following:

One Photo ID (not expired) from the following list:
Passport
Driving License
National ID

We accept JPEG, JPG and PNG file formats for upload. We do not accept PDF/Screenshots for Proof of ID.

The documents must show the same details (name, date of birth, address etc) as the details you used to register your account. If they do not match, verification will fail and you will be asked to provide either a marriage certificate or change of name deed (whichever is appropriate) to evidence any name change.

6.5 As a licensed external lottery manager and in compliance with our legal and regulatory obligations we are required to conduct a number of checks during the whole time that you have an Account with us. In order to meet our regulatory obligations, we may ask that you provide personal details and/or documentation relating to your financial circumstances.

6.6 You will agree to provide all such information as we reasonably require, in the form we require it, from you from time to time. If you do not or cannot provide us with the information that we need, we are entitled to restrict your Account in any manner that we reasonably deem appropriate, including preventing you from entering the lottery or withdrawing your funds. Your Account may also ultimately be suspended or terminated in accordance with clause 14.

6.7 You accept that all transactions may be checked to prevent money laundering and that any transactions made by you that we deem to be suspicious may be reported to the appropriate authorities.

6.8 We will process the personal information which you provide in connection with your registration in accordance with our Privacy Policy.

7 WALLET, DEPOSITS AND WITHDRAWALS

7.1 Within the Account, we will provide you with a Wallet. In order to purchase Ticket(s) you will first need to deposit funds into your Wallet.

7.2 You can only make payments to us by a Registered Payment Method. In relation to some forms of payment there may be a requirement for a minimum deposit level which will be advised to you at the time of the transaction. If your Registered Payment Method is a jointly owned bank account or joint debit card, you accept that all payments of winnings of £2,000 or less that we make to you from your Account will be paid to that joint account or card. If your Registered Payment Method is a debit card, it can only be used on one Account and it must not have been reported as lost or stolen. If you believe your card has been lost or stolen and you wish to use a replacement card as your new Registered Payment Method, or you wish to change your Registered Payment Method while there are funds or pending Tickets in your Account, you should contact our customer services team. We may require you to withdraw any existing funds and to wait for any pending Tickets to be completed before updating your Registered Payment Method. We reserve the right to perform such checks as we deem necessary to verify the ownership of the new Registered Payment Method before accepting it.

7.3 Funds in your Wallet may consist of any combination of the following:

(a) funds deposited using your Registered Payment Method;

(b) Prizes; and

(c) non-withdrawable Free Tickets.

7.4 We will apply the funds from your Wallet for ticket purchases by taking any funds in the ‘cash’ balance. The cash balance is made up of deposits you transferred via your Registered Payment Method and cash-equivalent payments from Prizes.

7.5 If your payment method has expired, you will be able to update your Account with the new payment method information without having to withdraw all the funds from your Wallet, and without waiting for a future Lottery Draw to take place.

7.6 If you tell your bank or building society that your Registered Payment Method has been used, without your authorisation, to make a payment into your Account, and they ask us to return the payment to your Registered Payment Method, we will suspend your Account and investigate the matter. If we must return a payment to your Registered Payment Method under this clause, and it would cause the balance on your Account to fall below zero, we will seek to recover the debt from you.

7.7 Subject to clause 3.1, you can ask us to close your Account at any time. If you wish to close your Account, you should tell us in writing, via e-mail, or letter (using the ‘Contact Us’ section of our website). Subject to clause 7.8, we will transfer the balance in your Wallet to your Registered Payment Method. If you have a Ticket in your Account when we receive your instructions to close it, we will suspend your Account immediately, and close it after the relevant Lottery Draw for all Lines shown on the Ticket has taken place.

7.8 If you wish to cancel a Direct Debit, you can do so by using the cancellation feature in the Direct Debit area of your Account. However, you should also contact your bank to ensure that the cancellation request has been received. It can take up to 5 working days for Direct Debit cancellations to take effect. If your next payment collection date is scheduled within 5 working days of your request to cancel a Direct Debit, we will still collect this payment and you will be entered into all Lottery Draws associated with this payment. If there are more than 5 working days until your next payment collection date, the Direct Debit will be cancelled and you will not be entered into any subsequent Lottery Draws.

7.9 If you set up a Direct Debit, the Direct Debit Guarantee Scheme applies.

7.10 Terms specific to payment by cards: Internet gambling may be illegal in the jurisdiction in which you are located; if so, you are not authorised to use your payment card to complete this transaction; It’s the cardholder’s responsibility to know the laws concerning online gambling in the Cardholder’s country; We prohibit the participation of website’s services to individuals under a lawful age;It’s recommended that you, the Cardholder, retain a copy of Transaction records, website terms and conditions and specific game rules.

7.11 Withdrawals may be subject to additional verification procedures as outlined in 6.4 to 6.7

8 WALLET LIMITS

8.1 We place deposit and total funds limits on your Wallet to promote responsible gambling, as set out in clause 8.2. We will always tell you if you have reached the limits.

8.2 Subject to clause 8.4, the maximum amount that can be:

(a) deposited into your wallet in a single transaction is £150;

(b) deposited into your Wallet at any given time is £150.

8.3 Our Computer System will not allow you to deposit more than these limits into your Wallet.

8.4 We will permit the overall balance in your Wallet to exceed £2,000 only if and to the extent that a Prize payment allocated under clause 12.6(a) causes this to happen.

9 PAYMENT OF PRIZES

9.1 If you win a Prize, and it causes the balance in your Wallet to exceed the limit set out in clause 8.2, we will do additional checks to verify your identity and then do one of the following:

(a) for payments under £2,000, we will transfer the relevant amount to your Registered Payment Method;

(b) for payments of £2,000 or more, make the payment to you by bank transfer. We may contact you to verify your bank details before making payment.

9.3 When you claim a prize, we will use our reasonable endeavours to make the Prize payment to you within fourteen days of receiving your identification documents. However, we will not have any liability for late payment.

9.4 Where we pay a Prize to an Excluded Person, or otherwise pay a Prize in error, the Prize must be returned immediately to us.

9.5 Each winning Player is responsible for paying any and all taxes on any Prize won.

10 CAN I CHANGE MY MIND?

10.1 We will only allow cancellation of a Ticket under exceptional circumstances (such as self-exclusion after you have bought a Ticket, or if material features of the Lottery have changed since you purchased the Ticket).

10.2 Except in the case of self-exclusion under clause 4, any cancellation or reversal must be completed at least one hour before the Lottery Draw for the relevant Lottery.

10.3 You may in certain circumstances request the repayment of your stake, if you bought a Ticket in advance of a Lottery Draw that is subject to a change in these Terms, prior to the point at which the changed Terms have been published by us on our website. You must send us an email request for repayment from your registered email address at least 48 hours in advance of the affected Lottery Draw.

10.4 You accept that if your application for a refund is accepted, your ticket will be withdrawn from the applicable Lottery Draw and will not be eligible for any Prizes in any subsequent Lottery Draw associated with that ticket.

10.5 For the avoidance of doubt, a Guaranteed Winner Draw Ticket cannot be cancelled.

11 THE LOTTERY DRAW AND TICKETS

11.1 After creating an Account as described in clause 6, you enter the Lottery Draw by purchasing a Ticket. Tickets cost £2 per Line.

11.2 You purchase a ticket by logging into your Account on our website or via our mobile App.

11.3 In order to enter the Lottery Draw, you must either:

(a) choose:

(i) three numbers between 0 and 9 inclusive; and

(ii) two letters from the English alphabet,

11.4 In the Lottery Draw, three Winning Numbers and two Bonus Letters will be drawn at random by the Random Number Generator (RNG). All three Winning Numbers will be drawn before the two Bonus Letters are drawn.

11.5 The Draw uses a GLI-certified RNG which is regularly tested by a Gambling Commission regulated testing house (iTech Labs) to ensure fairness and true randomness. You can see the certificate for our RNG at iTech Labs.

11.6 [Where you enter the Lottery Draw by way of a Free Ticket having been issued for Players who have met the promotion criteria set out in the terms and conditions of the relevant promotion, the entry shall be by way of a Lucky Pick only].

11.7 A Ticket will be valid only for the Lottery Draw(s) to be held on the date(s) shown on the lottery ticket detail stored in the lottery history area of your Account.

11.8 If you are a Subscription Player, we will enter you into the Lottery Draw on a continuous basis, unless you cancel your Direct Debit or recurring card payment. If you are not a Subscription Player, you may buy a Ticket that enters you into the Lottery for up to eight weeks in advance.

11.9 It is your responsibility to check at the time you buy it, that the date of the Lottery Draw and the numbers shown on the Ticket are those requested.

11.10 You may buy a maximum of £150 worth of Tickets in a single monthly period.

11.11 You may buy a Ticket up until the Draw Lockdown on the date of a Lottery Draw. After this time, sales will be closed for the associated Lottery Draw and you will only be able to buy a Ticket for a future Lottery Draw.

11.12 The result of the Draw in each Lottery will be published on the website and winners will be messaged via Email and/or SMS. We reserve the right to change the announcement arrangements for the Lottery Draw from time to time and will notify you of any such change either directly, if we have a valid email address for you, or through notification posted on our website.

11.13 Following purchase, we will send your Ticket details to your registered email address. A record of the Ticket purchase and details will also be stored on your account. Where the Ticket relates to more than one Lottery Draw, it will clearly display the date and time of all Lottery Draws to which entry has been made. [If there is any discrepancy between the information displayed on-screen and the information contained in the receipt we email to you, the information in the email receipt will always prevail, and we will treat the on-screen information as a display error. Each Lottery Draw will be verified by an independent auditor, who will record the Winning Numbers and Bonus Letters.

11.14 Subject to clauses 10 and 4, online entries are final and cannot be cancelled, reversed or refunded once completed.

11.15 If any Lottery Draw is interrupted due to a technical failure, or for any other reason, the draw will be deemed void and valid tickets will be transferred to the next available Draw. If a technical failure delays draws for an extended period of time, Blue Squid Studios may transfer a player’s tickets to the next available draw once normal service resumes or cancel remaining tickets and credit player’s wallet depending on the circumstance and length of time. Players will be kept informed via SMS and/or Email correspondence during any extended technical failure. A ticket has the same chance of winning, whichever draw it is entered into.

11.16 Your ticket confirmation, received via Email and/or SMS, and your “My Tickets” section in your Account will display the draw each ticket is entered in. Please check this to ensure you are aware which draw your tickets are valid in. In the rare event of a technical issue, or a payment delay, a Ticket may be entered into a later draw than intended by the player. Each ticket has the same chance of winning independent of which draw it enters. Blue Squid Studios may decide to compensate players in extreme circumstances via refund or free credits, at the sole discretion of Senior Management and on a case by case basis.

12 PRIZES

12.1 A Prize shall only be awarded to a winning Ticket that displays (i) the Winning Numbers or (ii) Winning Numbers and Bonus Letters recorded at the Lottery Draw by us and an independent auditor.

12.2 We will automatically notify Players via their registered email address if they have won a Prize.

12.3 You may only claim one Prize in respect of each Line.

12.4 We reserve the right to change the Prize sums paid to Players without further notice at our absolute discretion where we are required to do so by law, regulation or if the Gambling Commission tells us to do so.

12.5 Prizes will be rounded up to the nearest pound if required.

12.6 Subject to these Terms, Prizes paid to the holders of Tickets with Winning Numbers will normally be as follows:

(a) If two Winning Numbers are matched on your Ticket in any order, you will win one Prize of £5;

(b) If all three of the Winning Numbers are matched on your Ticket in the same order as they are Drawn, you will win one Prize of £500;

(c) If all three of the Winning Numbers and the two Bonus Letters are matched on your Ticket in the same order as they are Drawn, you will win one Prize of £25,000.

  • All three Winning Numbers and two Bonus Letters, all in the same sequence as the Draw (Jackpot) | £25,000 | One chance in 676,000.
  • All three Winning Numbers, all in the same sequence as the Draw | £500 | One chance in 1,000.
  • Matching two Winning Numbers in any order | £5 | One chance in 6.67.

Approximate overall odds of winning a prize: 1 in 6.67

(d) If all three of the Winning Numbers and the two Bonus Letters are matched in the same sequence on your Ticket as per the Draw, you will win a fixed Prize up to a maximum of £25,000. Where multiple Players are eligible to win the Jackpot, we will impose Prize Capping of up to £100,000 on the Prize pool, and share it equally amongst all those Jackpot winners, always subject to the maximum Prize amount you are permitted to win by law (namely, 10% of Ticket sales for that Lottery).

(e) If the total sum of Prizes due for payment in respect of any Draw exceeds £500,000, we reserve the right to implement Prize Capping to reduce the sum of the Prizes distributed to Players. In such circumstances, we may reduce all prize categories in proportion so as to bring the total Prize payout to a maximum of £500,000 for any single Lottery Draw.

12.7 From time to time, we may, at our absolute discretion, offer free raffles where each ticket in the draw has a chance to win a further guaranteed prize (for which see clause 13).

12.8 We may also, in our discretion, increase the potential Jackpot Prize total for a Lottery Draw, up to £100,000. No individual Ticket is entitled to a Prize more than the maximum amount permitted by law. Under the Gambling Act 2005, this means 10% of total Ticket sales for that Lottery or £25,000 whichever is lower. The Prize pool for each week’s Lottery Draw is calculated once the Winning Numbers and Bonus Letters have been drawn.

14 CLOSING YOUR ACCOUNT

14.1 We reserve the right to close your Account at any time, at our absolute discretion. If we do this, all monies held by us in your Wallet will be returned to your Registered Payment Method within 5 working days, unless clause 14.2 applies.

14.2 If you do not transact on your Account for a period of twelve months, your Account will be classed as dormant. We will e-mail you if your Account is likely to become dormant to tell you what you need to do in order to prevent this happening. If you take no action following the period specified in our correspondence with you, we will impose a dormant account administrative charge on Account at 5% of the account balance per month, unless and until the Account is re-utilised or the account has a balance of zero, at which point the account will be closed.

14.3 We may terminate, vary or suspend the provision of the Lottery, or access to your Account without prior notice:

(a) on breach of these Terms or the relevant Lottery rules; or

(b) if we stop managing the Lottery;

(c) where we are required by law to do so; or

(d) for any other reason at our sole discretion.

14.4 On termination of your Account or the Lottery, we will return your funds to your Registered Payment Method. In the event that a refund cannot be made the provisions made in Clause 14.2.

15 LIMITATION OF OUR LIABILITY

15.1 The Lottery is provided on an “as is” and “as available” basis and no representations of any kind are made in respect of the Lottery. All warranties, representations, conditions and all other terms of any kind whatsoever relating to the Lottery made by or on behalf of us, whether express or implied by statute or common law or in the course of dealing or otherwise implied, are to the fullest extent permitted by applicable law, excluded. We do not guarantee that use of our website, telephone system, broadcast or live transmission of the Lottery Draw will be uninterrupted, timely and/or error-free.

15.2 Nothing in these Terms shall exclude or limit our liability:

(a) for death or personal injury resulting from our negligence; or

(b) for fraudulent misrepresentation; or

(c) for any other liability that cannot be excluded or limited by law.

15.3 Subject always to clause 15.2:

(a) our liability to you is limited to the amount of any Prize which may have become due to you;

(b) neither we nor Cash for Kids shall be liable to you for any loss or damage suffered by you arising from:

(i) Incorrect or misuse of our website, mobile site, or mobile application (including the loss of opportunity to enter the Lottery and/or right to receive a Prize);

(ii) any problems, conditions, failures or delays arising from or relating to your network connections or telecommunications links or any other problems caused by your internet connection or in any other delivery methods used by us or you from time to time (including postal services or electronic banking);

(iii) any event which is beyond our or Cash for Kids’ reasonable control;

(iv) your failure to meet your obligations set out in clause 6.

(c) we are not liable in contract, tort (including but not limited to negligence) or otherwise in connection with the Lottery for:

(i) loss of revenue, contract, profits, business or anticipated savings or loss of data;

(ii) any special or indirect or consequential losses; or

(iii) any loss of goodwill or reputation.

15.4 Having implemented reasonable checks and safeguards to ensure that whilst you are self-excluded under clause 4, you cannot access your Account, we exclude all liability to you or any third party if you are able to continue entering the Lottery on our website.

15.5 We are not responsible for any websites which may be visited via hyperlinks provided on our website. Transactions made on such websites are conducted entirely at your own risk.

16 YOUR LIABILITY

16.1 You agree to fully indemnify us in respect of all liabilities, damages, claims, actions, expenses, demands or costs incurred by or awarded against us, due to your negligent conduct, omission or misuse of our website or your Account.

16.2 Nothing contained in these Terms shall affect your statutory rights. Our complaints procedure is available on request by writing to the address in 1.5 or by emailing support@lotto3.com.

17 RESERVATION OF RIGHTS

17.1 We reserve the right to:

(a) suspend our website, mobile application, and the provision of the Lottery for maintenance work required to upgrade or update our Computer System;

(b) exclude any Player from the Lottery if we believe, in our sole discretion, that the Player may be using technology to gain an unfair advantage over other Players of the Lottery;

(c) suspend or close an Account or refuse to set up an Account. This is at our absolute discretion, and we do not have to disclose our reasons.

18 MAKING A COMPLAINT

18.1 In the event of a complaint or to express any dissatisfaction with any aspect of the Lottery, you should email us on support@lotto3.com or call us on 0333 030 1230. Calls will be charged at local call rate.

18.2 If a complaint is not resolved to your satisfaction through our complaints procedure, and subject to the dispute meeting the criteria detailed in the Gambling Commission’s Code of Practice, you may refer your complaint to an independent adjudicator for further investigation and review. This independent adjudicator is called the Independent Betting Adjudication Service (IBAS),and specialises in the resolution of gambling disputes. 19 PERSONAL DATA AND PUBLICITY

19.1 All information provided by Players to us for the purposes of the Lottery will be stored, managed and used in accordance with current Data Protection legislation and also with our privacy notice posted on our website lotto3.com/privacy-policy. Our privacy notice forms part of and is incorporated into these Terms.

19.2 You acknowledge that we may want to carry out publicity activity relating to Players and Prizes. Except when we are required to do so by law, we will only make public information about you or your Prize with your written consent (or in the case of a syndicate, the written consent of the Syndicate Manager).

19.3 If you wish to be removed from our mailing list, you should:

(a) click on the unsubscribe link shown on all our e-mails; or

(b) change your preferences in your Account; or

(c) contact us at the address set out in clause 1.5; or

(d) Contact our Support team via email or phone. Calls to our contact centre will be charged at the local rate.

20 INTELLECTUAL PROPERTY

20.1 All intellectual property rights, including without limitation, copyright, trade marks, the underlying software, the design, graphics, layout, look and feel and structure of our website and social media sites or on other promotional material for the Lottery, database rights, design rights, domain names and rights to goodwill and/or to sue for passing off belong to us or our licensors. All intellectual property rights generated as a result of the operation of the Lottery shall also belong to us.

20.2 You are granted a licence to use our intellectual property rights and content only as expressly authorised by us or our licensors. You agree to take all steps (at our cost) to vest in us any intellectual property which you create in the course of entering the Lottery, or posting material on our website or social media sites.

20.3 You accept that the material and content contained within and displayed upon our website is made available for your personal non-commercial use. You are not permitted any other use of such material and content. You agree not to (and agree not to assist or facilitate any third party to) copy, reproduce, transmit, publish, display, distribute, commercially exploit, tamper with or create derivative works of such material and content.

21 GOVERNING LAW AND JURISDICTION

21.1 These Terms and any dispute or claim arising out of or in connection with them or the subject matter or formation (including non-contractual disputes or claims) shall be governed by and interpreted in accordance with the law of England and Wales.

21.2 Each party irrevocably agrees that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms or the subject matter or formation (including non-contractual disputes or claims).

22 WHAT HAPPENS TO MY MONEY IN THE EVENT OF INSOLVENCY?

22.1 We are required by our licence to inform customers about what happens to funds which we hold on account for you in the event of insolvency. The Gambling Commission provides further information on our licence conditions detailing what we need to tell customers about their funds.

We hold customer funds separate from company funds in a segregated account at Xace Bank. These funds are not protected in the event of insolvency: not protected segregation. For more information, please see the customer funds insolvency ratings system.

23 DEFINITIONS

23.1 Any words within these Terms that start with a capital letter shall have the following meanings:

Account” means the online account you set up with us when you register as a Player, and which is described in clause 6;

Bank Holiday” means a day when banks in England are generally closed for business;

Bonus Letter” means each of the two English language letters of the alphabet between “a” and “z” inclusive, drawn at random in the Draw, after the Winning Numbers are Drawn;

CIC” means The Giving Collective CIC, a registered Community Interest Company incorporated in England and Wales with company number 13627189;

Computer System” means the software and infrastructure we use to operate the Lottery;

Direct Debit Guarantee Scheme” means the scheme operated by banks and building societies, which protects you in the rare event that there is an error in the payment of your Direct Debit;

Direct Debit” means a recurring, scheduled payment from your Registered Payment Method for entry into multiple Lotteries;

Draw Lockdown” means the period of 30 minutes before a Draw during which it is no longer possible to buy a Ticket for that applicable Lottery;

Excluded Person” means a person who does not meet the eligibility criteria set out in clause 2 and who falls within any of the categories set out in clauses 3.1 and 4, together with such other persons (or category of persons) as the Gambling Commission may specify from time to time or as we, a relevant Charity and/or the Gambling Commission may agree from time to time. Any person who enters the Lottery but who does not comply with these Terms shall be considered an Excluded Person;

Free Ticket Draw” means any promotion that we may run from time to time offering the chance to get the value of a free Ticket as a Prize to Players who have met the promotion criteria as stated in the terms and conditions of the relevant promotion. The opening and closing dates for these promotions will be stated clearly on our website under the ‘Promotions’ tab;

Free Ticket” means a free Ticket that we may pay during a bonus promotion (for example, buy Ex worth of Tickets and get a free Line);

Funds” means money held in your Account that is available to use to purchase a Ticket or withdraw to your Registered Bank Account.

Good Causes” means projects aimed at the alleviation of child poverty and hardship in the United Kingdom;

Guaranteed Winner Draw” means a Lottery found on the Guaranteed Winner page of our website and in which the Player buys a Ticket to reveal the outcome of a Lottery immediately; “Jackpot” or “Jackpot Prize” means the top prize in any Lottery;

Guaranteed Winner Prize” means any Prize, whether a cash amount or a product, that we offer as part of any Guaranteed Winner Draw;

Line” means each individual selection of 3 numbers entered into a Lottery;

Lottery Draw” means the main lottery draw conducted on behalf of the CIC, normally 24 times per day, every day and references to the Lottery Draw in these Terms normally means the main lottery draw;

Lottery” means the society lottery held on behalf of the CIC, and comprising any or all of the following: the Lottery Draw, Guaranteed Winner Draw or other lotteries offered from time to time;

Player” means a person (including a corporate entity) who enters a Lottery and meets the eligibility criteria set out in section 3 and in the case of a syndicate, means Syndicate Manager;

Prize Capping” means the process that we may use to reduce the value of Prizes in certain circumstances such as when the total value of cash Prizes won by Players in a single Draw exceeds £25,000, or where the Jackpot total or Prize pool is capped at £100,000 when more than one Player has chosen the Winning Numbers in a Lottery;

Prize” means the prize monies, bonus (non-cash) prizes, or Quick Pick Ticket prize that may be won in a Lottery in accordance with these Terms and any other rules of a Lottery;

Lucky Pick” means a Line where all numbers and letters have been selected at random by our Computer System using a RNG;

Registered Payment Method” means the credit or debit card you use to buy a Ticket, or the bank or building society account held in your name from which you set up a Direct Debit into your Account;

RNG” means a random number generator which is used amongst other things for the Draw;

Subscription Player” means a Player who pays for a Lottery Ticket using a Direct Debit or recurring debit or credit card payment facility on a continuous basis;

Ticket” means the electronic ticket allocated to a Player by our Computer System which bears the numbers entered into the Lottery for that Player;

us” / “we” / “our” refers to Blue Squid Studio Ltd;

Wallet” means the part of your Account where deposited funds are held, from which you buy a Ticket, and into which we will normally pay Prizes;

Winning Number” means each of the three numbers between 0 and 9 inclusive, drawn at random in the Draw, before the Bonus Letters are drawn;

you” /“your” refers to a Player.

Terms” means these terms and conditions, as updated from time to time;

Deposit Bonus Terms & Conditions

1.1. The Promotion is open to residents of Great Britain aged 18 or over who set up a new online Lotto3.com account during the Promotion Period (please see 1.2 below).

1.2. The promotion will run from 11/12/2024 to 31/03/2025 (“The Promotion Period”).

1.3. New Lotto3 players who access the Lotto3 website at https://lotto3.com/ register a Lotto3 account or through a unique link through the Refer a Friend Program[SB1] , make a first-time deposit of at least £2.00 or more (two pounds), will automatically receive £2.00 of bonus credit in their online wallet.

1.4. The £2 bonus credit will appear as status ‘pending’ and can only be activated once a customer has purchased a £2 ticket for the Lottery Draw. At such point the £2 bonus credit will appear as active and is eligible to be used to purchase a further entry into the Lottery Draw

1.5. Customers must purchase a ticket within 7 (seven) of the ‘pending’ bonus being awarded after which the ‘pending’ bonus will expire.

1.6. Once the bonus credit becomes ‘active’, customers must spend their £2 bonus credit within 7 (seven) days of it being received into their online wallet after which time the bonus will expire.

1.7. Bonus Credit cannot be withdrawn and can only be used to enter Lottery Draws.

1.8. Players are required to add payment card details to their Lotto3.com to claim any prizes associated with online wins that may result from playing using this bonus credit.

1.9. Any monetary prize from a ticket entered into a Lottery Draw that has been paid for using Bonus Credit will be withdrawable.

1.10. Bonus Credit is fully paid for by lotto3. Once entered into a lottery draw it shall be treated as real money and as lottery proceeds.

1.11. Entries not complying with these T&Cs will not be valid.

1.12. The promoter shall have no liability for any system failure or other action or event which prevents a player from entering the Promotion

1.13. Employees of Blue Squid Studios Ltd, The Giving Collective, and the Gambling Commission, as well as their immediate families are not eligible to participate in the Promotion.

1.14. The Promoter reserves the right to cancel this Promotion or to vary the Promotion or these T&Cs at any time by giving notice on the Site.
